1 General information
1.1 Purpose of the Privacy Policy
This Privacy Policy informs you which of your data is stored, processed and shared by codeframe GmbH, Buckhauserstrasse 5, 8048 Zurich, Switzerland (hereinafter «code:frame» or «we» or «us»).
We take the protection of your personal data very seriously. We have taken technical and organizational measures to ensure that the legal provisions on data protection applicable in Switzerland and the European Union are observed both by us and by external service providers.
1.2 Personal data
Personal data is information that concerns your person and can be assigned to you. This includes information such as your name, address, postal address and telephone number. Information that cannot be directly linked to your real identity (such as the length of time spent on the website or the number of users of the website) is not included.
1.3 Scope of application
The data protection declaration applies in particular to data processing for mere visitors to the websites of code:frame -> see section 2, to data processing in the event of further use of our websites -> see section 3 as well as data processing for the execution of orders -> section 4.
For non-code:frame websites to which the products of ad:frame are delivered and to which the products link, no guarantee for compliance with the data protection provisions is assumed.
1.4 Person responsible for data processing
Code:frame is responsible for the processing of personal data, unless this privacy policy contains deviating information.

1.5 Persons entrusted with the processing of your data
All persons who work with your data are bound by the relevant legal regulations of Switzerland or the EU and contractually bound by code:frame’s privacy policy.
Insofar as data is transferred to data processing bodies outside the European Union, we assure you that the required data security is maintained.
2 Data processing during the mere visit of our websites
2.1 Server log files
If you only use our website for your independent information, i.e. if you do not create a customer account or transmit information to us in any other way (contact form, etc.), we only collect data that is transmitted to our server by your browser (so-called «server log files»). This data is technically necessary to display the website to you.
When you call up one of our web pages, we, therefore, collect the following data:
- Name of the website or file accessed
- Date and time at the time of access
- Amount of data sent in bytes
- Source/reference, from which you reached the page
- Browser used
- Operating system used
- IP address used (if applicable: in anonymized form)
The server log files are not merged with other personal data that you actively provide within the framework of the website – e.g. in your customer account.
This data is processed in accordance with the relevant legal provisions and on the basis of our legitimate interest in improving the functionality and stability of our websites. We reserve the right to subsequently check the server log files only in the event that there are concrete indications of illegal use.
The data is not passed on or used in any other way when you simply visit our websites. However, see below, in particular section 3.1 (ad:frame tool).
2.2 Use of cookies
To ensure optimal functioning of our websites, to improve your user experience and to collect general usage information, the use of so-called cookies is resorted to in some places. Cookies are small text files without personal data that are temporarily stored on your computer and can be easily deleted at any time (via your browser settings). Cookies are also automatically deleted, sometimes immediately at the end of the so-called browser session and sometimes after a certain duration, which may vary depending on the cookie.
You can influence the use of cookies: By changing your browser settings (mostly found under «Option» or «Settings» in the menus of the browsers), you have the choice to accept all cookies, to be informed when a cookie is set or to reject all cookies. If you decide not to accept our cookies, it may be possible that the functionality on our pages is reduced and some services can not be used. We ask for your understanding of this.
2.3 Online marketing and analysis services
2.3.1 Google (Universal) Analytics
We use Google Analytics on our websites, a web analytics service provided by Google Inc. («Google»). Google Analytics uses «cookies», which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. In the event that IP anonymization is activated on this website, however, your IP address will be truncated beforehand by Google within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be merged with other data from Google. You may refuse the use of cookies by selecting the appropriate settings on your browser, however, please note that if you do this you may not be able to use the full functionality of this website. We would like to point out that on this website Google Analytics has been extended by the code «anonymizeIp» to ensure an anonymized collection of IP addresses (so-called IP masking).
2.4 Google Maps
We use Google Maps from Google LLC., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter «Google») on our websites to show you our location and to make it easier for you to find us.
If you call up a sub-page in which we have integrated Google Maps, information about your visit to our website (such as your IP address) is transmitted to Google’s servers in the USA and processed there. It is not relevant whether you have created a user account with Google and/or whether you are logged in there. If you have a user account with Google and are logged in there, the data of your visit will be directly associated with this account. If you do not wish this, you must log out of Google before visiting our website.
Google stores the data of your visit and evaluates them. You must assert your right to object to this data processing directly against Google:
Google is based in the USA. However, Google is certified under the «Privacy Shield» data protection agreement, which ensures compliance with the level of data protection applicable in the EU.
3 Data processing in the event of further use of our websites
3.1 Online forms
If you contact us via our websites (e.g. by contact form or other inquiry), we will collect and process personal data. It is apparent from the respective online form which data is collected in the respective form of contact.
If you fill out and submit an online form on our websites or request access to the online offers of code:frame, you consent to code:frame collecting, processing, using and passing on your personal data for the purposes stated in this privacy policy.
The data will be stored and used exclusively for the purpose of processing your request. Provided that it is clear from the circumstances that your request has been conclusively clarified and provided that there are no legal retention obligations to the contrary, your data will be deleted after the final processing of your request.
3.2 Use of single sign-on procedures through social login
The online offers of code:frame, in particular also ad:frame, do not enable social login. However, third-party providers of code:frame (e.g. Amazon, Adition) may provide this option for our customers. In this case, however, data is exchanged directly between our customers and the third-party provider.
3.3 Newsletter
If you register for our newsletter, we will use the data you provide and the e-mail address you enter to send you the newsletters you have selected. You can unsubscribe from a newsletter at any time.
With your registration you agree that we may use your personal data for e-marketing purposes such as sending e-mails with advertising or marketing content (newsletters), sending invitations to events or for customized advertising. You may withdraw your consent at any time and unsubscribe from all of our marketing campaigns at any time by clicking the «Unsubscribe» link found at the bottom of each of our mailings. If you continue to be a customer of ours – e.g. via subscription – we will retain your customer data within the scope of the above sections 2 and 3 as well as section 4 below.
For the technical processing of our e-marketing activities, we use https://mailchimp.com (hereinafter «Mailchimp»). Mailchimp is an online marketing platform operated by The Rocket Science Group LLC. 4 Data processing for order execution
4.1 Retention and use of customer data
Code:frame uses the personal data of customers primarily to fulfil contractual obligations, especially in connection with the automated creation of advertising materials via the homepage https://staging.www.adframe.ch.
We use the personal data of our customers (e.g. name, postal address) for the following general purposes:
- for the management of the customer relationship with you, including the processing of invoices addressed to you;
- for communications and information concerning your customer relationship;
- to respond to your questions and messages sent to us;
- to measure interest in and improve our services and online offerings;
- to inform you by e-mail or post about innovations that may be of interest to you;
- to resolve disputes;
- to troubleshoot problems;
- to prevent potentially prohibited or criminal activities;
- to enforce our terms and conditions;
- as well as for other purposes disclosed to you at the time of data collection.
5 Your Rights
5.1 Rights of access and intervention
You have the right to receive information about the personal data that has been stored about you free of charge upon request (from the second information within 12 months, we may charge a fee).
In addition, you have the right to correct incorrect data, the right to request the restriction of processing of data that has been processed too extensively and the right to delete personal data that has been processed unlawfully or stored for too long (insofar as this does not conflict with any legal obligation to retain data and no other reasons according to DSG and Art. 17 Para. 3 DSGVO). In addition, you have the right to transfer all data you have provided to us in a common file format (right to data portability).
Consents granted can be revoked at any time with effect for the future. To exercise your rights, an email to privacy [at] openframe.ch is sufficient.
In addition, you also have the right to complain to a data protection supervisory authority.
5.2 Right of objection
In all those cases where we process your personal data on the basis of our overriding legitimate interest, you have the right to object to this processing on individual grounds arising from your particular situation. You have this right at any time and the objection is effective for the future.
As soon as we are aware of your objection, we will stop processing the data concerned. We reserve the right to continue processing if we can demonstrate compelling legitimate grounds for the processing that override your interests or if the processing is carried out for the purpose of asserting or exercising legal claims.
6 No other disclosure of personal information
Apart from the cases mentioned in this privacy policy, we generally do not pass on your data to third parties outside of codeframe GmbH. Your personal data will not be sold under any circumstances.
However, if we are required by law or court order to do so, we will pass on your data to authorities entitled to receive information.
7 Duration of storage of personal data
Personal data will be deleted as soon as they are no longer needed for order processing, processing your request, etc. and/or we no longer have a legitimate interest in the continued storage of data. Longer legal retention periods (e.g. retention periods under commercial and tax law) remain reserved, in particular for data stored in the context of contract processing.
